Terms of service

These Terms of Service ("Terms") govern your use of Kensi ("the Service"), a voice-to-text application for macOS and iOS, operated by Open Growth Group Inc. ("Company", "we", "us", "our"), located at 1111B S Governors Ave STE 37208, Dover, DE 19904 US.

By downloading, installing, or using Kensi, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Kensi is a voice-to-text application that converts speech to text using on-device speech recognition and optional AI-powered correction. The Service includes:

You must be at least 13 years old to use Kensi. If you are under 18, you must have permission from a parent or legal guardian.

Free tier and Voice tier. No account or registration is required. You may use the Service without providing any personal information.

Cloud, Privacy, and Everything tiers. These tiers require a license key. You are responsible for keeping your license key secure. Do not share your license key with others.

Each license key is valid for use by one individual on their personal devices (Mac and iPhone). We reserve the right to revoke license keys that are shared or used in violation of these Terms.

Kensi offers a free tier (3,000 words per week) and paid subscription plans. Prices are listed on our website and may change with 30 days' notice.

Subscriptions. Paid plans are billed monthly or annually. Subscriptions auto-renew unless cancelled before the next billing cycle. You can cancel your subscription at any time through the app settings or by emailing hello@kensi.ai. Cancellation takes effect at the end of your current billing period — you retain access until then. Your local data (transcripts, settings, vocabulary) remains on your device after cancellation.

Refunds. If you are unsatisfied with a paid plan, contact us within 14 days of purchase for a full refund. After 14 days, refunds are at our discretion.

Free tier. The free tier provides 3,000 words per week (a "word" is any sequence of characters separated by whitespace). The quota resets every Monday at midnight UTC. When the limit is reached, dictation is paused until the next reset — existing transcripts and features remain accessible. No credit card is required.

You agree not to:

Kensi, including its code, design, branding, and documentation, is owned by us and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal or professional use.

Your content. You retain full ownership of all text, transcripts, and content you create using Kensi. We claim no rights to your content. We do not use your content to train AI models.

We respect the intellectual property rights of others. If you believe that content generated or shared through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notice must include: a description of the copyrighted work you claim has been infringed, a description of the material you claim is infringing and where it can be found, your contact information, a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law, a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner, and your physical or electronic signature.

We will respond to valid DMCA notices in accordance with applicable law, which may include removing or disabling access to the allegedly infringing material. Repeat infringers may have their access to the Service terminated.

Kensi uses AI models to correct, rewrite, and generate text. AI-generated output may contain errors, inaccuracies, or unintended content. You are responsible for reviewing and editing all output before use.

We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose. Do not rely on AI output for medical, legal, financial, or safety-critical decisions without independent verification.

Your privacy is fundamental to how Kensi works. The Privacy Policy at kensi.ai/privacy-policy is incorporated into these Terms by reference. Please review it for details on how we handle your data.

In summary: speech recognition is always on-device. Audio is never uploaded to our servers. On the Cloud tier, only text (never audio) is sent for AI correction and immediately discarded.

Kensi may integrate with third-party services (Slack, GitHub, Linear, Notion, Google Workspace) at your request. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or practices of third-party services.

The following terms apply to your use of Kensi when downloaded from the Apple App Store:

These Terms are between you and Open Growth Group Inc. only, and not with Apple Inc. ("Apple"). Apple is not responsible for Kensi or its content.

Apple has no obligation to provide any maintenance or support services for Kensi. If Kensi fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Kensi.

Apple is not responsible for addressing any claims by you or any third party relating to Kensi or your use of Kensi, including but not limited to: product liability claims, any claim that Kensi fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

In the event of any third-party claim that Kensi or your use of Kensi infringes a third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

We aim to keep Kensi available and reliable, but we do not guarantee uninterrupted service. We may release updates, modify features, or discontinue parts of the Service at any time.

System requirements. Kensi requires macOS 14+ or iOS 18+. On-device AI features require Apple Silicon (M1 or later).

From time to time, we may offer features labeled as "beta," "preview," "experimental," or similar designations. These features are provided for testing and feedback purposes and may be incomplete, contain bugs, or change significantly before general release.

Beta features are provided "as is" without any warranty. We may modify, suspend, or discontinue any beta feature at any time without notice or liability. We make no commitment that beta features will become generally available.

Do not rely on beta features for critical or production workflows. Any data created with or stored in beta features may be lost if the feature is modified or discontinued.

To the maximum extent permitted by law, Kensi and its creators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Kensi is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, that AI output will be accurate, or that the Service will meet your specific requirements.

You agree to indemnify, defend, and hold harmless Open Growth Group Inc. and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: natural disasters, war or terrorism, pandemics or epidemics, internet or infrastructure outages, government actions or regulations, labor disputes, or failure of third-party services.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. All remaining provisions shall continue in full force and effect.

You may stop using Kensi at any time by uninstalling the Service and cancelling any active subscription.

We may suspend or terminate your access if you violate these Terms. Upon termination, your license to use the Service ends. Sections that by their nature should survive termination (intellectual property, limitation of liability, disclaimer of warranties) will survive.

We may update these Terms from time to time. Material changes will be communicated through the app or our website at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms, together with the Privacy Policy (incorporated herein by reference), constitute the entire agreement between you and Open Growth Group Inc. regarding the Service.

These Terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.

No failure or delay by us in exercising any right under these Terms shall constitute a waiver of that right.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any legal proceedings arising from these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware.

Binding Arbitration. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA). If you are using the Service as an individual, the AAA Consumer Arbitration Rules shall apply. If you are using the Service on behalf of a business or organization, the AAA Commercial Arbitration Rules shall apply. Arbitration will take place in Wilmington, Delaware or remotely at your election.

Opt-out. You may opt out of this arbitration agreement by sending written notice to hello@kensi.ai within 30 days of first agreeing to these Terms. If you opt out, disputes will be resolved in the courts specified in the Governing Law section.

Small claims exception. Either party may bring an individual action in small claims court instead of arbitration, provided the claim falls within the court's jurisdictional limits.

Class action waiver. You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.
